VitalSync respects intellectual property. If you believe content on VitalSync infringes your copyright, you can send us a Digital Millennium Copyright Act (DMCA) notice and we will respond in accordance with 17 U.S.C. ยง512.

How to submit a takedown notice

Include all of the following so we can act on your notice:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you claim was infringed.
  3. Identification of the material that is allegedly infringing, including a URL sufficient for us to locate it.
  4. Your address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on its behalf.

Counter-notice

If you believe your content was removed as a result of mistake or misidentification, you may submit a counter-notice including:

  1. Your physical or electronic signature.
  2. Identification of the material removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where your address is located (or, if outside the US, any district in which VitalSync may be found) and that you will accept service of process from the original claimant or its agent.

Repeat-infringer policy

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. Accounts receiving multiple valid takedown notices are subject to suspension and permanent termination.

Misrepresentations

Under 17 U.S.C. ยง512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please consider carefully before filing.
